Terms and Conditions
The conditions defined in this regulation apply only between the company ad ballet designer srls, based in Monza (MB), via Ippolito Nievo 1, VAT 10152470968 registered in the REA No. MB-251084 which hereinafter will be called aliceedanza and the customer who purchases online on the website www.aliceedanza.com
The conditions stated here may be subject to changes over time and the date of publication of the same on the site is equivalent to their coming into effect.
These conditions govern only the purchases made on the site www.aliceedanza.com , in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code, Legislative Decree No. 206/2005, amended by Legislative Decree No. 21/2014 and by Legislative Decree 70/2003 regarding electronic commerce.
GENERAL CONTRACT PROVISIONS
- The general sales conditions present on this site serve to establish that aliceedanza sells and the CLIENT purchases at a distance the goods indicated through the online store present on the site www.aliceedanza.com; The contract will be concluded exclusively through the internet.
- Before proceeding to confirm their order, the CUSTOMER agrees to review these general sales conditions and to accept them by checking the box indicated to validate the existing contract.
- The CUSTOMER will receive an order confirmation email also containing the link to download and archive and/or a pdf copy of these sales conditions, as legally required or to check the status of the shipment.
- The sales contract is concluded with the sending to the CUSTOMER by aliceedanza of an order confirmation email. The email contains all the CUSTOMER's data along with other information such as the order number, the delivery address to which the goods will be sent, and the price of the goods purchased by the customer and the successful payment, as well as the link that will be useful for the CUSTOMER to print and archive a copy of these conditions and/or a pdf copy of the same.
- aliceedanza may refuse to accept an order if one of these conditions occurs:
- a - the items are currently not available in the online store;
- b - it is not possible to obtain payment authorization;
- d - the price of a product is listed with an incorrect amount;
- and - in case the order is not complete with all the necessary data to close the sale.
- The CUSTOMER agrees to verify that their personal data entered in their profile and in the order are correct and, if not, agrees to promptly communicate any corrections to aliceedanza at the address. ordini@aliceedanza.com,
- All purchase orders for products sent to aliceedanza must be complete in every part and must contain all the necessary elements for the correct identification of the ordered products. Each order of products sent constitutes a contractual proposal from the customer and therefore will be binding for aliceedanza only if confirmed by the customer for acceptance. The fulfillment of the order by aliceedanza is equivalent to confirmation and acceptance of the same.
- Order fulfillment is subject to the receipt of the (advance) payment of the amount due to aliceedanza according to the chosen payment method; only then will the order be completed.
- Payment can be made very conveniently and quickly via all credit and prepaid cards linked to a Paypal account, Satispay, or by bank transfer. The aliceedanza website guarantees maximum security for online payments. The Paypal platform allows for the payment to be split into three installments with no additional fees, in case you choose to consult the relevant site, and aliceedanza does not assume any responsibility.
- If the transaction is made via PayPal or Satispay payment method and the credit companies confirm the payment has been made, usually immediately, then the shipment will depart within 3 or 4 working days. In the event that the CUSTOMER decides to use the bank transfer method, the CUSTOMER agrees to send a copy of the transfer receipt directly to orders@aliceedanza.com to allow aliceedanza to perform a cross-check with the bank. Only after verifying the successful payment will aliceedanza commit to shipping the goods within 3 or 4 working days. For this reason, the goods will be shipped only after receipt of payment, with no exceptions to this rule.
- In case of non-execution of the order by aliceedanza (if this is due to the unavailability of the products ordered by the Customer), the seller will promptly inform the customer and agree on the method of refund: either by refunding the amounts that the customer may have already paid for the unexecuted supply or by replacing the product in case the customer chooses an alternative.
- Unless otherwise indicated, the prices of the products published by aliceedanza are to be understood as inclusive of VAT. The prices of the products published from time to time by aliceedanza cancel and replace the previous ones unless the Customer has already finalized the order (at that point, the agreed and finalized price remains); they are always and in any case subject to the actual availability of the Products.
- Shipments will be made via express courier in STANDARD mode, and in general, the goods, including the technical times described in point 9 of the aforementioned contract, will be received by the customer within 6 or 7 working days, unless there are issues like those in point 10 that will be promptly communicated or issues not attributable to aliceedanza but to the courier.
- The cost of STANDARD shipping is €10, even for the larger Italian islands (Sicily and Sardinia), and this amount is regularly displayed at the end of each order. The cost of shipping in Europe is a flat rate of €25.00. The virtual store aliceedanza ships to Italy and parts of Europe. The goods will be shipped, and this action will be communicated to the CUSTOMER by sending a specific email message at the moment the products leave the store's premises. At any time, you can check the status of your order by accessing the Reserved Area of the website within the section called 'My Orders.'
- In any case where the package shows signs of tampering, the CUSTOMER must promptly report it at the time of delivery, ensuring to sign the specific Proof of Delivery document prepared by the courier with a reservation.
- In the event of non-delivery of the products to the specified address due to the recipient's absence, the courier will leave a postcard to certify the first delivery attempt. The postcard will contain the information that the CUSTOMER must use to independently contact the courier and arrange an appointment for the second delivery attempt, in order to avoid the package being held in storage, a situation that will exclude aliceedanza from any responsibility. Storage is a paid service; therefore, the costs and responsibility for goods held in storage for reasons not attributable to our error are always borne by the recipient.
RIGHT OF WITHDRAWAL
- aliceedanza guarantees the full satisfaction of the CUSTOMER during their shopping; therefore, in accordance with the legal provisions in force, if the CUSTOMER changes their mind, they have the right to withdraw from the purchase without any penalty and without having to provide reasons for their change of mind. The right of withdrawal can be exercised within 14 days of receiving the goods, allowing for a refund of the price paid, excluding any shipping costs incurred at the time of the order.
- The CUSTOMER who wishes to exercise the right of withdrawal must communicate it to aliceedanza by registered mail with acknowledgment of receipt or through direct communication entered in the reserved area 'My account' on the site, which allows for returns by clicking on the menu item 'Return Ticket'.
- In the return procedure, the CUSTOMER must specify the order number and the details of the goods they intend to return; at this point, they can submit the ticket. Once the ticket is received, aliceedanza will assess the situation and, if the return conditions have been correctly met, will send an email of Authorization for the return within 24 hours. Authorization will be denied otherwise. If the return is accepted, the CUSTOMER must print the Authorization email, include it in the package, and ship the products within 14 days of receiving the goods.
- In case the customer wants to return for a size change or other issues they want to resolve, it is advisable to send an email to ordini@aliceedanza.com By communicating the reason, the Customer will be contacted to agree on the best way.
- Returns sent cash on delivery are not accepted.
- The right of withdrawal does not apply to the supply of goods made to measure or personalized, such as some items modified in advance before shipment if requested by the Customer.
- The responsibility, risks, and costs of returning the goods are the responsibility of the Customer.
- In case of withdrawal, the Customer is required to return the goods within 14 days from the day they communicated to aliceedanza their intention to withdraw from the purchase contract of the goods which must be returned to aliceedanza, Via I: Nievo 1-20900 MONZA (MB)
- The costs related to the return are the responsibility of the CLIENT who assumes full responsibility for it and can proceed with the return in any way they prefer: the courier to which aliceedanza is subscribed may offer an adequate service, following the instructions provided precisely.
- The products purchased and then returned must be in the same condition in which they were shipped by aliceedanza, packed in their original intact packaging which must not be damaged in any way. The goods must be intact without having been used, washed, ironed, or altered in any other way, and the attached tax documentation must be present. In the event that the handling of the product, such as fit, has resulted in a decrease in the value of the product itself, then aliceedanza will be authorized to request a monetary refund proportional to the decrease in value of the returned product.
- According to Italian law, the right of withdrawal is reserved for the Consumer natural person acting for purposes unrelated to any entrepreneurial or professional activity carried out.
- Once the good condition of the returned products and the existence of all return conditions have been verified, aliceedanza will proceed with the refund within 14 days from the receipt of the goods using the method used by the CLIENT at the time of purchase. In the case where the payment was made by bank transfer, the CLIENT will provide their IBAN to receive a transfer regarding the return.
- As provided by art. 56 paragraph 3 of Legislative Decree 206/2005 amended by Legislative Decree 21/2014, aliceedanza may suspend the refund until the goods are received or until the CLIENT demonstrates otherwise.
PERSONAL DATA REGULATIONS
- The collection and processing of data provided by the customer are carried out in accordance with the law. It is the user's right to consult, modify, or have their data deleted by writing to ordini@aliceedanza.com
